Federally Regulated Employees

While most employees working in Ontario are protected under the Ontario Employment Standards Act, there are many employees who work with federally regulated employers. These employees are governed by a different law - the Canada Labour Code.

The Canada Labour Code provides minimum protections for employees who work in federally regulated sectors including the following:

  • Banks (including TD, RBC, Scotia Bank, CIBC, BMO)

  • Telecommunications (Bell, Rogers, Freedom, Telus)

  • Transportation

  • Radio and Television

  • Delivery (FedEX, UPS, Canada Post)

Unjust Dismissal Protection

Most federally regulated employees have greater job protection than Ontario employees. Unlike Ontario employees who can be terminated without cause for any reason, federally regulated employees can only be terminated for certain reasons including just cause, lack of work, or position elimination. Most federally regulated employees cannot be terminated without cause and simply be provided a severance package. If an employee is terminated without cause, they may be entitled to reinstatement or their job back. They can also claim a severance package.
