Terminations for Cause
While most employment terminations are done on a without cause basis, there are many instances where employees find themselves terminated for cause, or just cause. In these instances, employees will not be provided any notice of termination, termination pay, or a severance package. Terminations for cause are extremely serious and often called the “capital punishment” of employment law.
Jason Wong regularly helps employees in these difficult times. The most important thing to know about terminations for cause is that they are rarely upheld by a court. Employers must have very good evidence to establish just cause for termination. Simple mistakes will not be enough.
If an employer does not have cause to terminate, the termination becomes a “without cause” termination and allows the employee to collect a severance package. On behalf of employees, Jason can help negotiate with former employers or sue them in court, if necessary.
